The CCPOA Basic Combined Legal Program
Legal Protection for Yourself & Your Family

The CCPOA Basic Combined Legal Program is specifically developed to coordinate the unique professional and personal legal needs of today's Correctional Peace Officer.  The CCPOA Basic Combined Legal Program is the only legal program offered as an association benefit - and the only program to coordinate at-home and on-the-job legal plans.

Unlike any other prepaid legal plan offered to State employees, the CCPOA Basic Combined Legal Program is provided free-of-charge to all Bargaining Unit 6 employees (including PIE and Fair Share), as well as RO6, SO6, CO6, MO6 CCPOA members. You do not have to do anything to sign up for this plan, other than to join CCPOA.1

The CCPOA Basic Combined Legal Program consists of two coordinated legal plans; the Basic LDF Legal Plan specifically designed for your professional (on the job) needs, and a personal Basic Family Legal Plan administered through Caldwell Legal USA to assist you with legal questions and estate planning, as well as other personal legal issues for your "at home" legal planning needs.

As a Correctional Peace Officer, your personal and professional future is at risk every day.  The CCPOA Basic LDF Legal Plan was developed by the CCPOA Benefit Trust Fund and the CCPOA Legal Fund Board to protect its membership, especially when the State refuses to represent you for "course-and-scope incidents" occurring while you are at work.

In addition to the legal liabilities you face on the job, periodically you may need to talk to a lawyer about personal legal issues. Most of us don't hire a lawyer, however, simply because lawyers cost too much. This is no longer true for you. Effective September 1, 2002, every CCPOA member has group legal services called the CCPOA Family Legal Plan. For rank and file, this is one of your collectively bargained benefits.  For CPO supervisors and managers, this benefit is provided as part of the CCPOA dues structure. So now you have no excuse to not go to a lawyer.

It is our commitment that our membership deserves quality legal protection when the State "declines" to represent for on-the-job occurrences - incidents which are part of the course and scope of a normal job assignment, pursuant to the terms of the Plan documents.

As a Correctional Peace Officer, you know that the situations and stresses you face everyday are outside the comprehension of the average citizen. It's a fact that you are more likely to need someone to rely on for competent legal advice or even to defend you - especially if your case becomes controversial and the State politically "backs off" - leaving your professional career and personal finances hanging out to dry.

Why does our membership need an on-the-job legal plan?
The Federal and State Departments of Justice are increasingly "second guessing" inmate or parolee shootings and injuries. It is not a matter of "if," but when they may come to investigate you.
The number of potential adverse criminal and civil investigations and lawsuits against our membership continues to grow.
New-Benefits for CCPOA Supervisory Members - the only labor organization offering correctional peace officer-based legal plans, CCPOA recognizes that its Supervisors have the same legal exposure as its rank and file members.

Shouldn't the State of California pay for your legal expenses? In theory, yes, but this is no longer a given. Increasingly, the State is refusing to legally protect Correctional Peace Officers in instances where "excessive" force is alleged, or where there is heavy media attention focused on a situation. This is why the CCPOA Benefit Trust Fund developed the CCPOA Basic Combined Legal plan - to help watch your back.

The CCPOA Basic LDF Legal Plan protects your  professional future through the guidance of LDF Panel attorneys and staff that have the legal background and expertise necessary to represent you - the professional correctional peace officer - when you are in trouble.

This means, as a CCPOA member, you are eligible for legal representation in any civil or criminal action, investigation and certain court proceedings arising out of the course and scope of your employment (subject to the plan caps and the terms of the plan document).

Effective September 1, 2003, the Basic Legal Defense Fund Coverage has increased by $10,000 for both civil and criminal coverage. The aggregate civil coverage benefit has also been raised from $150,000-$200,000. For matters occurring as part of the course and scope of your employment, the Basic LDF Legal plan provides the following benefits for all active Bargaining Unit Six and CCPOA Supervisory Members:

$60,000 individual

This gives plan participants up to $70,000 each of Civil and Criminal liability (subject to the aggregate caps and to the charged offenses being considered within course and scope of employment). Unfortunately, many lawsuits will cost you more than this. Hence you need to consider enrolling in our voluntary, supplemental LDF plan, known as the CCPOA Premier Legal Plan.

CCPOA Basic Family Legal Plan

The Basic Family Legal Plan provides legal representation for most of your private legal needs. The CCPOA Basic Family Legal Plan is your key to open the door to a frequently inaccessible justice system. Think you don't need a lawyer?   • WILL. Single party will, including testamentary trust provisions (as needed) for minor children. One per year. Free to enrolled member.
  • WILL REPOSITORY at your Legal Service office. A safe place to keep your Will.
  • CONTRACT & DOCUMENT REVIEW by your Legal Service Office. Simple matters, up to 10 pages, free.
  • AGENCY REFERRALS. Your Legal Service Office can assist you in reaching a solution by directing you to the appropriate private or government agency.

  • Identity Theft Protection Kit - The Identity Theft Protection Kit includes preventative measures and lists the vital first steps to take if member suspects his or her identity has been stolen. The kit includes forms to report ID theft to the appropriate parties. Provided to members free-of-charge upon request.
  • Homestead Benefit - Documents prepared free-of-charge for the primary residence of single or married members. Member must provide a copy of their most recent deed. Does not include fees such as those charged by Notary Public or County Recorder’s Office. Extra attorney fees may apply if there are other persons with interests in the property other than member and his or her spouse. California Resident.

  • REVOCABLE LIVING TRUST - A/B revocable trust provisions (as needed) plus the following: Durable Powers of Attorney for Health Care, Durable Powers of Attorney for Financial Management, and Pour-Over Wills. $795.00
  • REDUCED RATES - 25% off the Attorney's usual and customary fee for probate, elder law, probate litigation, title insurance law, tax law, securities law, anti-trust law and matters which involve three or more days of court or hearing time.

    Covered Persons - CCPOA Member, spouse, dependent children, stepchildren or legally adopted children, up to age 23.

    The CCPOA Reduced Rate

    Extended service and in-court representation for most legal matters (including administrative hearings before the State Personnel Board) arising from off-duty conduct, is available from participating attorneys at a reduced rate of $85 an hour. This is a tremendous savings from the national average of $184.00 per hour typically charged by partner attorneys. Additionally, in family court, you might be ordered to pay for your spouse's legal fees as well as your own. You can hire different referral attorneys for yourself and your spouse at the CCPOA Reduced Rate.*

    Mediation Services

    The CCPOA Basic Combined Legal Plan makes mediation services available to its members when litigation is not the best way to proceed with a legal matter. You may receive a written review of your options, as well as suggestions on how to negotiate a conflict.

    Mediators are available at a reduced hourly rate.

    Mortgage Assistance

    Would you like to pay off your mortgage and other long-term bills much sooner than you'd planned and save thousands in the process? You will have access to the Equity Savings Plan. This will allow you to restructure your payment schedule on any existing loan (such as you home mortgage, equity lines of credit, motor home, automobile or boat loan), without the expense of refinancing. The Equity Savings Plan will give you significant savings in interest payments and reduce your loan's effective rate over the life of the loan.
